Did I say I have lot of time and energy at my disposal ??

Sending a DMCA counter notice does not take much time and energy. It takes exactly 10 mins to file a counter notice. And an energy equivalent to 90 calories :)

It only needs understanding of Fair Use clause and willingness to take on those who file frivolous DMCA complaints

Pardon me for saying this, but I'm not sure you have an understanding of fair use… Here is a quote from the same website that you gave in your post: "If in doubt about your fair use assessment, consult with a copyright attorney". I did… four of them, in fact. All four of them had *exactly* the same opinion... Don't even think about trying the fair use defense here. Perhaps all four of them, practicing copyright attorneys, have no idea of what they are talking about…

If one doesn't own the copyright, why should there be the attempt to copy and share through websites?

Forget Youtube. The copyright owner (Indian) may sue the uploader (Indian) in India.

Before taking the risk, it is better to save money to pay for legal expenses and damages.

The bigger threat is of coming generations not having access to snapshots of - what will be considered by posterity - a very unique phase in Indian Music .
Sangeethveda is another rich store house . I never thought I would watch the Bhimsen Joshi I had experienced in the 80s , once again in my life - through the audio visual mode.

I would have thought that the Justice process would consider the act of not allowing access to the thirsty masses , an act of piracy . i-)

legal? - let the composers bother about it. I am concerned about the double-speak of those who claim copyrights as to what they do unto others whose works they cling on to like uDumbu.

OK, I know now what you mean. On a lighter note, may be the performers' defense is, since they routinely murder the lyrics they are not copying :) They definitely have a lot of evidence to support that argument!
